Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard, in that, employees were exposed to being struck by vehicles while working along the road and crossing the road without wearing any reflective vest: a) On or about June 11, 2007 at 5040 Vineland St, Metairie, LA employees were exposed to being struck by vehicles while working along the road without wearing any reflective vest. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to train and instruct employees to wear reflective vest while working along the road.
