Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of a fall or tripping hazard.
a) On or about June 18th,, 2007, at 3834 Veterans Blvd, Metairie, LA, an
employee working
from the basket of a JLG aerial lift had a large deteriorating  hole were
the employee stood. The
employee was  exposed to fall through-hazard and/or a tripping hazard  in
that the aerial lift was
found  in need of repair and was not removed from service.  Among other,
feasible and
acceptable means to correct this hazard, in addition to following the
manufacturer's and
equipment manufacturer's guidelines to make sure the aerial lift is in
good repair.
