North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by falling materials hazards: a)tire storage and repair room, while the material hoist was elevated to the 2nd floor, the area underneath the hoist was not secured to prohibit employees from walking and standing below the suspended hoist. Reference: CM Valustar Electric Chain Hoist operating, maintenance & Parts Manual, pages ii, iii 10, safety procedures # 5 and 6. One feasible and acceptable method to correct this hazard is to make sure all persons stay clear of the suspended load.nded
