Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm in that
employees were exposed to the
hazard of being caught between the moving elevator car and the hoistway
wall due to a
malfunctioning car gate:
Warehouse, East Freight Elevator.  The elevator car was able to move with
the car gate
in the raised position.  Employees rode the elevator between the first and
fourth floors
of the warehouse with the car gate open, and were exposed to the hazard of
being caught
between the moving car and the hoistway wall.
A feasible means of abatement, among others, would be to repair and
maintain the
elevator in accordance with the national consensus standard of the
American Society of
Mechanical Engineers, ASME A17.3-2002, "Safety Code for Existing Elevators
and
Escalators - 2002."  Section 3.4.2 requires that elevator car doors/gates
be equipped with
an electric contact to prevent operation of the car unless the car door or
gate is in the
closed position.
Abatement certification is required for this item in accordance with the
requirements of
29 CFR 1903.19(c).
