Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazard: On February 16, 2006, and other times prior thereto, at this freight forwarding warehouse, truck trailers with side swinging doors were not positively prevented from movement at all times while being boarded with a powered industrial truck (forklift). Operator employees were exposed to a fall and struck-by hazard. Among others, one feasible means of abatement would be to implement a policy of adequate and positive warning to the forklift operator of a pending truck trailer movement (e.g. pulling away from the dock).
