Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: On or about August 25, 2006, employees of a subcontractor were cutting holes in the roof while employees of a second subcontractor were engaged in decking activities. The employer did not establish a controlled decking zone and limit access to the roof to employees engaged in decking activities. Employees were exposed to the hazard of falling twenty-six (26) feet to the ground below. Among other methods, one feasible method of abatement would be to establish a controlled decking zone and limit access to the roof to employees engaged in decking activities.
