Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees installing exhaust pipe for an air containment system at IC of Oklahoma LLC. The employer permitted employees to utilize an unauthorized modification to a shackle by inserting a common bolt in place of a missing shackle pin. Employees are exposed to the hazard of being struck by falling pipe due to failure of a shackle. Among other methods, one method of abatement would be to ensure that all equipment used for rigging is intended for that purpose and is not modified in any way.
