Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: At the jobsite on or about 01/04/07 the employer allowed an employee to operate a rough terrain type forklift without using the seat belt as required by ASME B56.6-2002. The employee was exposed to the type of hazards associated with caught in between. Among others, one feasible and acceptable method of abatement would be to comply with the requirement of ASME B56.6-2002, Safety Standard For Rough Terrain Forklift Trucks, section 6.2.1(a), Operating Safety Rules and Practices.
