Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: On or about February 28, 2007, the employer did not provide employee(s) working on the monkey board a secondary mean of egress. The only mean of egress for employees was the derrick ladder , the use of which could be blocked by the hazards of oil and gas well blow outs, fire, and/or derrick collapse. This exposes the employee to the hazards of burns, falls, struck- by, and/or caught-by.
