SCRR 71-112A: Failed to furnish a place of employment which is free of
recognized hazards
which may cause death or serious physical harm to his employees and comply
with this
regulation and other occupational safety and health rules and regulations
promulgated under
Chapter 15 of Title 41, Code of Laws, State of South Carolina, 1976, as
amended, as
follows:
A.  Employer knew or should have known that a materials box elevated by a
JCB 506C
model forklift, Identification Number 587053, at rear left side, 2nd floor
balcony of Building
17, on or about August 7, 2006, in excess of 10 feet high that was not
secured to the forks
constituted a hazard of the load shifting while two employees removing
windows from the
materials box were stepping into and out of the box and of the box
slipping from the forks
and falling to the ground with the employees being crushed by the falling
box and/or
windows.  A feasible and useful method, among others, to correct the
hazard is to secure the
box to the forks and/or lifting carriage.
