Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to death and serious injuries from a substandard suspended unguarded platform. Elevated work platforms used with Rough Terrain Forklift Trucks as designed by the manufacturer must meet design, construction, and use requirements as outlined by the American National Standard Institute ASME/ANSI B56.6, 2002, Safety Standards for Rough Terrain Forklift Trucks, Section 5.15.1 (k): restraining means such as railings, chains, cables, harness(s) with lanyard(s) were not in place or properly used. Also, section 8.24.1(b): Platform width was greater than 10 inches past the width of the load bearing tires on either side. a) On 12/27/06, employees of A&M Concrete Construction, Inc. were working on an elevated platform extended by a Sky Trak, all terrain lift which did not meet the design and use requirements of ASME/ANSI B56.6, the following areas: 1. Side, front and back guardrails were missing on the metal work platform, exposing employees to a fall hazard. 2. The metal work platform extended more than 10-inches past the load bearing tires on each side. 3. The work platform was not secured to the forks on the Sky Trak rough terrain vehicle. Among other methods, feasible and acceptable means to correct these hazards are to use a safer alternate method such as the use of a platform approved by the manufacture meeting the requirements of ASME/ANSI B56.6-2002 for the attachments on rough terrain lifts and ensure the appropriate size of the working platform, with railings, and ensure that the platform is securely attached to the forks. Abatement Certification required.
