Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to multiple injuries and or death from falls or tip over of
an elevated work
platform:
a) At the site, employees were exposed to a fall of 20 feet when working
on a work horse
plank mounted on the midrails of the work platform, were exposed to the
unsecured platform
sliding off the forks of the rough terrain forklift, and a tip over hazard
due to the oversized
platform used. The work platform used to elevate employees did not meet
the design and use
requirements of the American Safety Standards of Rough Terrain Forklift
Trucks ASME/ANSI
B56.6-2002, in the following areas:
(1) Section 8.24.1(b): Platforms did not have a width greater than the
overall
width of the truck measured across the load bearing tires plus 10 inches
on either
side.
(2) Section 8.24(f); Information was not prominently indicated on the
platform (1)
the maximum work load including personnnel and equipment (2) the weight of
the
empty platform information prominently marked on the platform.
(3) Section 8.24(h): The platform was not secured to the lifting mechanism.
(4) Section 5.15.1(u): Elevating Personnel; Personnel are to maintain firm
footing
on platform floor unless secured by a body belt and lanyard.
Among other methods, feasible and acceptable means to correct these
hazards are
to use safer alternate methods such as a scaffold or use a platform
approved by
the manufacturer or meet the design, manufacture, and user requirements of
ASME/ANSI B56.6-2002; Safety Standards For Rough Terrain Forklift Trucks.
Abatement Certification or Abatement Documentation required.
