Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to multiple injuries and or death from falls or tip over of an elevated work platform: (a) At the site, employees were exposed to a fall of 18 feet when working on an unsecured platform capable of sliding off the forks of the rough terrain forklift, guard rails missing on the front side of the platform with no other fall protection systems used, and a tip over hazard due to the 16 foot oversized platform used. The work platform used to elevate employees did not meet the design and use requirements of the American Safety Standards of Rough Terrain Forklift Trucks ASME/ANSI B56.6-2002, in the following areas: (1) Section 8.24.1(b): Platform had a width greater than the overall width of the truck measured across the load bearing tires plus 10 inches on either side. (2) Section 8.24(f); Information was not prominently indicated on the platform (1) the maximum work load including personnel and equipment (2) the weight of the empty platform information prominently marked on the platform. (3) Section 8.24 (h): The platform was not secured to the lifting mechanism. (4) Section 8.24 (l) There was no use of a restraining means such as a guard rail or a means for securing personnel such as a safety harness with lanyard. Among other methods, feasible and acceptable means to correct these hazards are to use safer alternate methods such as a scaffold or use a platform approved by the manufacturer or meet the design, manufacture, and user requirements of ASME/ANSI B56.6-2002; Safety Standards For Rough Terrain Forklift Trucks. Abatement Certification or Abatement Documentation required.
