Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:

proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando
o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
The Company Cutler Hammer Electrical Company is being cited by the Section
6 (a) of
the Act, by reference to ANSI B151.1 "Horizontal Injection Molding
Machines", which
is a recognized standard industry practices, which provides the Safety
Requirements for
the Manufacture, Care and Use of Horizontal injection molding machines
a)unexpected energizing, start up or release of stored energy hazards;
point of
operation hazards; caught in/between hazards; rotating and/or moving parts
hazards; hot surface hazards; hot melt splash hazards; electric shock
hazards. The
employer did not employ all safety devices, guards, and proper operating
procedures as set forth in manuals and other regulations including ANSI
B151.1
Horizontal Injection Molding Machines - Safety Requirements for
Manufacture,
Care and Use, during the operation in the molding area of fifteen (15)
injection
molding machines (MOIM001, MOIM002, MOIM003, MOIM005, MOIM010,
MOIM011, MOIM015, MOIM017, MOIM018, MOIM019, MOIM020,
MOIM021, MOIM022, MOIM052 and MOIM053). Machines were operated with
the following conditions:
1- Machine safety plates were cover with paint and illegible.
2- Machines were operated with bypassed safety devices.
3- Purge guards were removed from machines.
4- Employees were permitted to operate machines without been taugh safety
and
machine operating procedures outlined on the machine manual and in the safe
method of operation of the safety devices.
5- The employer did not ensure by adequate supervision that correct
operating
procedures were followed.
6- All safety interlocks were not funtionally checked at the beginning of
each
shift.
7- A clearly defined border was not painted around the machine working
area.
8- Electrical circuits were altered without authorization from the
manufacturer.
9- There was visual evidence of hydraulic oil leakage (accumulation of
hydraulic
oil around machine working areas)
10- Machines without safety devices or guards
"Among other methods one feasible and available method to correct these
hazards is to
operate and maintain the injection molding machines as per machines
operation and
maintenance manual and as per the Requirements of ANSI-B151.1"
La Compania Cutler Hammer Electrical Company, esta siendo citada por la
Seccion 6(a)
de la Ley, utilizando como referencia el ANSI B151.1 "Horizontal Injection
Molding
Machines",  que es un estandar reconocido de la industria de practicas
recomendadas,
que provee los requisitos de seguridad  para la fabricacion, cuidado y uso
de maquinas
de inyeccion horizontal
a)energizacion, encendido o liberacion de energia almacenada de forma
inesperada;
riesgos de puntos de operacion; ser atrapado en, entre; riesgo de partes
rotativas
y/o en movimiento; riesgo de superficies calientes; riesgo de salpicadura
de
material derretido caliente, riesgos de descargas electricas. El patrono
no empleo
todos los dispositivos de seguridad, guardas, y procedimientos de operacion
apropiados segun especificado en manuales y otras regulaciones incluyendo
el
ANSI B151.1 Horizontal Injection Molding Machines - Safety Requirements for
Manufacture, Care and Use, durante la operacion en el area de moldeo por
inyeccion de quince (15) maquinas de moldeo por inyeccion (MOIM001,
MOIM002, MOIM003, MOIM005, MOIM010, MOIM011, MOIM015,
MOIM017, MOIM018, MOIM019, MOIM020, MOIM021, MOIM022,
MOIM052 and MOIM053). Las maquinas eran operadas  en las siguientes
condiciones:
1- Las placas de seguridad estaban cubiertas con pintura y no eran
legibles.
2- Las maquinas eran operadas con dispositivos de seguridad desviados
3- Las guardas de purga fueron removidas de las maquinas.
4- A los empleados se les permitio operar las maquinas sin haber sido
ensenados
los procedimientos de seguridad y de operacion de las maquinas
establecidas en
el manual de operacion ni en el modo de operar de los dispositivos de
seguridad.
5- El patrono no se aseguro mediante supervision adecuada que los
procedimientos de operacion correctos se estaban siguiendo.
6- Los entrecierres de seguridad no fueron funcionalmente cotejados al
inicio de
cada turno.
7- No se delimito un area de trabajo definida alrededor del area de
trabajo
de las
maquinas.
8- Se alteraron circuitos electricos sin la autorizacion del manufacturero.
9- Habia evidencia visual de filtraciones de aceite hidraulico (habia
aceite
hidraulico acumulado en areas alrededor de las maquinas)
10- Maquinas sin dispositivos de seguridad o guardas
Entre otros metodos, un metodo disponible y apropiado para corregir estos
riesgos es
operar y mantener las maquinas de moldeo por inyeccion segun especificado
en el manual
de Operacion y Mantenimiento de las maquinas y en el ANSI-B151.1
