Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by collapsing building
components due to inadequate
bracing:
a) Worksite - On or about November 10, 2006 the wall sections for two
stories, a floor
section and roof of a townhome under construction collapsed as the
temporary wall
bracing needed to support the structure was not installed on one front
wall section.
Among other methods, one feasible and accepted method of abatement is to
install and
maintain temporary wall bracing as detailed on sheet SP-1 entitled Safety
Procedures
contained in the building plans prepared by the developer, NVR Inc. Ryan
Homes, and
further described on page 5 of the Performance Specification Phase 110 -
Framing Labor
which requires one brace be installed every ten feet along the wall
section.
