Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck or buried by finished product being loaded
into the trailer while
they were picking ceramic or waste from the finished product in the
trailer of the truck:
a)  Yard, Finished Glass area -- picking employees enter an approximate
40-foot trailer
body being loaded to remove ceramic and waste from finished glass product
as the loader
operator continues to dump 10-foot wide bucketfuls (approximately 10,000
pounds each)
of the finished glass product into the trailer, on or about 9/13/07.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is:
1.  Develop and enforce a written standard operating procedure, train all
the
employees, and enforce the procedure.
2.  Install mirrors at strategic locations to allow the loader operator to
be able to
view the inside of the trailer, where the employees are working, from
different
angles.
3.  Install warning devices on top of the trailer which warn the loader
operators
that a person is in the trailer.
4.  Use and enforce the use of a buddy system (a co-worker to signal the
loader
operator that it is safe to dump the load).
Or in the alternative:
29 CFR 1910.146(c)(4):  The employer did not develop and implement a
written permit space
program that complies with this section for employees entering
permit-required confined spaces:
a)  Yard, Finished Glass area -- picking employees enter an approximate
40-foot trailer
body being loaded to remove ceramic and waste from finished glass product
as the loader
operator continues to dump 10-foot wide bucketfuls (approximately 10,000
pounds each)
of the finished glass product into the trailer, on or about 9/13/07.
Abatement note:  This hazard may be abated through the implementation of a
Permit
Required Confined Space Program (in writing) which includes:
1.  An evaluation of the workplace to determine if any confined spaces are
permit-requied,
2.  Measures necessary to prevent unauthorized entry,
3.  Identification and evaluation of the hazards in permit spaces before
employees
enter them, and
4.  Development and implementation of the means, procedures, and practices
necessary for safe permit space entry operations.
Abatement certification required within 10 days after abatement date.  The
certification
shall include a statement that abatement is complete, the date and method
of abatement,
and state that employees and their representatives were informed of this
abatement.
