North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to a fall of approximately 10
feet:
a)jobsite, 485 Sutro Forest Dr. (Lot 118) - for the employee performing
brick work
while standing on the midrail of a platform being lifted by a rough terrain
forklift, the employer failed to ensure the employee maintained firm
footing on
the platform.  The employee was approximately 10 feet above the ground.
ASME/ANSI B56.6-2002 (Safety Standard For Rough Terrain Forklift Trucks)
states "A rough terrain forklift truck shall not be used to lift people
unless there
is no other practical option.  If a rough terrain forklift truck must be
used to lift
people, the following precautions for the protection of personnel shall be
taken:
(u) personnel are required to maintain firm footing on platform floor
unless
secured by body belt and lanyard.  Use of railings, planks, ladders, etc.,
on the
platform for purpose of achieving additional reach or height is
prohibited."
Among other abatement methods, the employer could abate the hazard by
requiring employees to maintain firm footing on the platform floor or
instructing
those employees being lifted to direct the forklift operators to raise
them to proper
heights.s
