North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)worksite - the employee driving the backhoe at the time of the accident was not wearing his seat belt. Note: A feasible method to abate this hazard is to enforce the usage of seatbelts during the operation of the backhoe.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)worksite - the employee standing in the trench while the back filing was in process was to close to the backhoe. Note:A feasible method to abate the hazard is to ensure that the employee is not standing behind the backhoe during the back filing process.
