Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing and struck-by hazards:
(a) Service Department -  The employer failed to maintain the automotive
lifts in a safe
operating condition, such as, but not limited to, broken safety latches;
disconnected limit
switches; leaking hydraulic cylinders; proper lubrication; damaged
equalizer chains; and
establishing procedures to periodically inspect the automotive lifts.
Employee(s) working under
elevated vehicles were exposed to crushing and struck-by hazards in the
event the vehicles would
collapsed from their elevated position on lifts such as, but not limited
to seven (7) Challenger
two post surface mounted lifts, one (1) Forward two post surface mounted
lift and a hunter
surface mounted lift/rack.
Among other methods, one feasible and acceptable method to correct this
hazard is to
include, but not limited to the following:
(1) Conform to the American National Standards Institute/Automotive Lift
Institute Standard for
Automotive Lifts Safety Requirements for Operation, Inspection, and
Maintenance, ANSI/ALI
ALOM-2000, Section 5 and 6.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.
