Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to fall and struck-by hazards:
On or about November 24, 2006, employer did not have programs developed or
implemented
that addressed unauthorized riders on the skid steers used by employees at
the workplace nor had
the employer provided employees with information and training to avoid
unsafe conditions while
operating skid steers. Employee at the workplace was riding in the
elevated bucket of the John
Deere, Model 325, skid steer was exposed to hazards associated with
struck-by.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO
CORRECT THIS HAZARD IS:
a)Comply with all the safety guidelines that is outlined in the operators
manual
for the John Deere, Model 325, Skid Steer which prohibits
personnel/employees from riding in the bucket.
b)Train all employees/operators in the proper use and limitations of the
skid
steers.
29 CFR 1903.19(d)(1) requires certification and documentation that the
abatement of the
above violation is completed.
