Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling. On or about February 2, 2006 at the work-site located at Tennant J. Jill, Space 507, Turtle Creek Mall in Jonesboro, Arkansas an employee working from a self-propelled elevating work platform [Grove Model SM2232E,scissor lift] was exposed to injuries from falls should the lift malfunction causing a collapse, overturn or other adverse action because the owner did not cause frequent and annual inspections to be performed on the lift. One feasible method of abatement, among others is to cause frequent inspections to be performed in accordance with Section 6.6, FREQUENT INSPECTION and Section 6.7, ANNUAL INSPECTION of the American National Standard Institute, ANSI/SIA A92.6-1999
