Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with tower collapse. Among other methods, feasible and acceptable means of abating this condition include, but may not be limited to: ensuring that employees follow proper procedures for the assembly of guy wires for securing communication towers, including the installation of Austin in-line porcelain insulators, in accordance with manufacturers' specifications.

Among other methods, feasible and acceptable means of abating this condition include, but may not be limited to ensuring that employees follow proper procedures for ensuring that Gin pole(s) used to dismantle or erect Rohn 25G tower(s) are those specified by the manufacturer or are designed and engineered in accordance with the manufacturer's specifications and with the National Association of Tower Erectors (NATE).
