Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: On or about February 13, 2006, and other times prior thereto, at this location, employees were washing out vacuum truck tanks from the top hatch opening approximately 10 feet from the ground, without a fall protection system. One recognized and feasible abatement means to prevent exposure to this hazard, includes, but is not limited to, the use of a guardrail system or a personal fall arrest system.
