Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: On March 27, 2006 and other times prior thereto, at the south end of Vehicle Storage Area, Dry Bulk trailers, employees engaged in the inspection and service of bulk trailers while standing upon tank elevated walking/working surfaces were not protected against fall hazards of up to over 11 feet above grade. Among other methods, one feasible and acceptable means of abatement would be to implement a written fall protection program for the main and any remote worksites, conduct fall protection training for affected employees, and provide personal protective equipment for all potentially exposed employees.
