T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: In that an unauthorized employee was observed riding on a JCB 214e (412162)Powered Industrial Backhoe Loader. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train employees on the safety rules and operations of a Powered Industrial Backhoe Loader. In addition, instruct unauthorized employees not to ride on the backhoe loader.
