North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by/caught in: a)maintenance shop, the defective in-ground and above ground, hydraulic lift had not been inspected by a qualified inspector nor maintained by qualified or maintenance personnel as required. REFERENCE: American National Standard Institute/Automotive Lift Institute Standard for Automotive Lifts Safety Requirements For Operation, Inspection and Maintenance (ANSI/ALI ALIOIM-2000): Chapter 5, Periodic Qualified Inspection; and Chapter 6, Maintenance.
