North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to:
a)fall from elevation - jobsite, employees working from a
fabricated metal platform, elevated by a JGL rough
terrain forklift.  The platform was constructed with one
open side, no mid rails, no toeboards, and the top rail
was 36" high.  The employer did not take measures to
protect employees from exposure to a fall hazard and did
not ensure the platform was properly designed and
constructed.
NOTE:  Among other methods, one feasible and acceptable method of
abatement is to utilize a Gradall/JGL manufactured personnel work
platform as recommended by the manufacturer.  Another would be to
construct a work platform that complies with ANSI B56.6.  Employees
must also be equipped with fall protective systems as outlined in
29 CFR 1926 Subpart M - Fall Protection.
