Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the facility, the Clark electric forklift was not equipped with a seatbelt. this condition exposed employees to the hazard of being struck-by the forklift in the event of a tip/roll over accident. The forklift was used for purposed such as but not limited to; unloading trucks and moving bundles of lumber in the shop area. Employees were also exposed to hazards associated with being thrown from the forklift or striking the structure of the forklift in the event of a driving accident. Among other methods, one feasible and acceptable abatement method to correct the hazard is to equipment the forklift with a seatbelt, require that forklift operator(s) use the seatbelt and train employees on proper seatbelt usage.
