Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
a. Receive injuries due to that at the time of the inspection at the
establishment Municipio
de Ponce-Alcaldia, first floor, paymaster and collector office, employees
performed
office operations and did not comply with all the occupational safety and
health
regulations issued pursuant to this act in that employees where exposed to
hazards
and/or
illnesses such as but not limited to headaches, eyes strains and/or
aggravated lost of
eyessight due to:
1. Poor illumination levels in the range of 4.5fc to 47.9fc when
recomended lighting
levels for office operations are in the range of 75fc to 150fc. of
luminescense, as state
in ANSI/IESNA RP-1- 1993 standards.
Among other methods, one feasible and acceptable abatement method to
correct these
hazards is to:
1.  Make the appropiate repairs accodingly and expeditious to increase the
office
luninescence as state in ANSI/IOESN RP-11993 standars for office lighting.
2.  Relocated employees to a place free from these and other recognized
hazards.
a. Recibir lesiones debido a que al momento de la inspeccion en el
establecimiento
Municipio de Ponce-Alcaldia, primer piso oficina de pagaduria y
recaudaciones,
empleados realizaban operaciones de oficina y no cumplio con todas las
regulaciones de
seguridad y salud emitidas de acuerdo a esta ley en que los empleados
estaban expuestos
a riesgos y/o enfermedadedes tales como pero no limitadas a migranas,
cansancio visual
y/o perdida de vision agravada, debido a:
1. Niveles de iluminacion pobre, en los rangos de 4.5fc a 47.9fc de
iluminacion cuando
los niveles de iluminacion recomendados para operaciones de oficina son en
el rango de
75fc a 150fc de luminescencia, segun establecido en los estandares del
ANSI/IESNA RP-
!-1993.
Entre otros metodos, un metodo aceptable y factible para corregir este
riesgo es:
1. Hacer las reparaciones requeridas y en forma expedita para aumentar la
luminiscencia
de la oficina segun se establece en los estandares del ANSI/IESNA
RP-1-1993
para
iluminacion en oficina.
2. Reubicar los empleados a un area que este libre de estos y otros
riesgos reconocidos.
