Section 5(a)(1) of the Occupational Safety & Health Act of 1970:The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by approaching vehicles: a)First flagging station, northbound lane of Highway 95 North - Highway 95 North & Eastport Road Project - 105 Highway 95 North, Eastport, ID; On and or about 5/31/06 and at times prior thereto, the employer did not take measures to prevent a flagger from stepping out and/or standing in front of approaching traffic, which exposed the employee to the hazard of being struck by approaching vehicles. Traffic speeds ranged from 0 to 45 mph with a mix of heavy truck and car traffic. b)First flagging station, southbound lane of Highway 95 North - Highway 95 North & Eastport Road Project - 105 Highway 95 North, Eastport, ID; On and or about 5/31/06 and at times prior thereto, the employer did not take measures to prevent a flagger from stepping out and/or standing in front of approaching traffic, which exposed the employee to the hazard of being struck by approaching vehicles. Traffic speeds ranged from 0 to 45 mph with a mix of heavy truck and car traffic. Among other methods, one feasible and acceptable method to correct this hazard is to comply with the 'Flgging Handbook' published by the American Traffic Safety Service Association (ATSSA), 14th Edition, 15M, May 1994 or other association's/state's handbooks requiring flaggers to always stand in a highly visible location, and never stand directly in the path of an approaching vehicle. Note: Abatement certification or documentation is NOT required for this item.
