Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling and/or being thrown from a forklift: a)Main warehouse area - Hayden Beverages - 1445 Commerce Avenue, Boise, ID; On or about 6/7/06 and at times prior thereto, the employer did not instruct and/or enforce the utilization of seat belts by operators of counter balanced, center controlled high lift trucks with sit-down non-elevating operator positions, which exposed them to hazards including but not limited to being thrown from the lift. Among other methods, several feasible and acceptable methods to correct this hazard is by complying with the manufacturer's operation guide regarding use of the manufacturer supplied seatbelts and/or QNWI/ITSDF B56.1-2005 (Reaffirmation of ASME B56.1-2004), Section 7.41, Operator Restraint Systems Note: Abatement certification or documentation IS required for this item.
