Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Springwood Drive and Autumn Way at Eagle Road, Meridian, ID; On or about 7/26/06 and at times prior thereto, the employer did not prevent an employee from riding in the bucket of a truck mounted aerial lift in the lowered/travel position while the truck traveled away from area of work and through a residential area at speeds of 35 mph or more, which exceeded the posted 25 mph speed limit and exposed the rider to the hazard of being thrown around in and/or from the bucket. Note: Abatement certification and documentation IS required for this item. A feasible means of abatement for this item would for the employer to comply with 1) ANSI Standard A92.2-2001, for Vehicle Mounted Elevating and Rotating Aerial Devices, Section 9.5 , Subsection (4) "Under all travel conditions, the driver shall limit travel speed in accordance with conditions of the ground surface, congestion and slope, 2) Comply with the posted speed limit, 3) drive the most direct route from one point of work to the next and/or 4) remove the employee the basket before proceeding to other locations.
