employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
being struck by approaching/passing
vehicles and/or construction equipment:
a)Flagger stations, centerline of roadway - Lake Street/Highway 55
Re-paving Project - Lake Street between
Mission/Mather, McCall, ID; On and or about 9/20/07 and at times prior
thereto, the employer directed
employees flagging traffic to position themselves in the middle of the
roadway and/or opposing traffic lane
prior to stopping and/or after releasing traffic, which exposed them to
the hazard of being struck by
approaching/passing vehicles and/or construction traffic. Traffic speeds
ranged from 0 to 25 mph with a
mix of heavy truck/car traffic.
Among other methods, one feasible and acceptable method to correct this
hazard
is to comply with the 'Flagging
Handbook' published by the American Traffic Safety Service Association
(ATSSA), 14th Edition, 15M, May 1994
or other association's/state's handbooks requiring flaggers to always be
positioned at or as close to the shoulder of
the approaching traffic lane as feasible.
