Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by motor vehicles while working on public streets: (a) Work Site - corner of Fremont and Baker Streets - On May 23, 2007, and at times prior thereto, the employer did not ensure that employees exposed to being struck by motor vehicles were wearing appropriate high-visibility apparel. (b)Work site - corner of Fremont and Baker Streets - On May 23, 2007, and at times prior thereto, the employer did not ensure that employees exposed to being struck by motor vehicles were protected by appropriate traffic cones and/or barricades. Note #1: Abatement certification required for this item. Note #2. Among others, feasible and accepted methods to correct the hazard would be to follow the requirements outlined in the ANZI Z133.1, American National Standard for Aboricultural Operations - Safety Requirements: Assure that highway work zones are in accordance with Chapter 3, General Safety Requirements, Section 3.2, Traffic Control Around the Job site, paragraph 3.2.1: High-Visibility safety apparel and head gear, when required, shall conform to ANSI-ISEA 107-2004 and the U.S. Department of Transportation (DOT) Manual on Uniform Traffic Control Devices (MUTCD). Assure that highway work zones are in accordance with Chapter 3, General Safety Requirements, Section 3.2, Traffic Control Around the Job site, paragraph 3.3.3: Temporary traffic-control devices used in Aboricultural Operations shall conform to the U.S. Department of Transportation (DOT) Manual on Uniform Traffic Control Devices (MUTCD) and applicable federal and state regulations,
