Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being pinned under, crushed, or thrown from a forklift truck. (A) At the establishment on June 13, 2007, and at times before that, a Japanese manufactured fork lift was in operation without the seat belt as required in ASME B56.1-1993. Among other methods, one feasible and acceptable abatement method to correct this hazard is : (a) Ensure that all fork lift seats designed to accept seat belts are equipped with working seat belts (b) Train or retrain all fork lift operators on the hazards and requirements to use seat belts at all times. Note: Abatement certification required for this item.
