Section 5(a)(l) of the Occupational Safety and Health Act of 1970:   The
employer did not furnish employment and a
place of employment which were free from recognized hazards that were
causing or likely to cause death or serious
physical harm to employees in that employees were exposed to the hazards
of falling from a man-lift basket, when the
basket which was elevated on the forks of a powered industrial truck:
Consensus Standard ASME B56.1-2000, Safety Standards for Low Lift and High
Lift Trucks, Paragraph 4.17.2(c):
Whenever a truck is used to elevate personnel, the following precautions
for the protection of personnel shall be taken:
Be certain that required restraining means such as railings, chains,
cable, body belt(s) with lanyards, or deceleration
devices, etc., are placed and properly used.
Employees were elevated up to approximately 10 feet in height in a
man-lift basket on the forks of a Hyster Powered
Industrial Truck Model S80 XL, Serial D004D05316V, Truck #534.   The
basket was not guarded with adequate
railing, in that the access end of the basket did not contain a midrail.
The employees did not use any other means of
fall protection.   One such example of this occurred on or about April 25,
2006
while an employee was in a man-lift
basket elevated by the truck to access the top of a palletizer.
Feasible Method of Correction
a)Install a midrail on the access end of the basket.
b)Use a safety harness with lanyard attached to the mast or basket

effective abatement method.
Abatement certification and abatement documentation is required for this
violation.   The documentation should include
written verification of abatement, applicable measurements or monitoring
results, and photographs or videos which you
believe will be helpful.   The abatement certification sheet is enclosed
with the citation(s).
