Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were being exposed to the hazard of falling and being struck by material
handling equipment:
a.On or about May 19, 2006, an employee was riding up and down and working
from the bucket of the Caterpillar 420D, exposing the employee to the
hazard of
falling and being struck by the equipment.
Amoung other methods, one feasible and acceptable method to correct this
hazard
is to follow the safety information contained in the Association of
Equipment
Manufactures Safety Manual on the machine that states the machine is a one-
person machine and never permit riders.
ABATEMENT CERTIFICATION IS REQUIRED.TION
