Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: a.On or about January 29, 2008, the scrap metal load on the 1985 GMC truck was not blocked or braced with dunnage to prevent the load from shifting, exposing the employee to the hazard of being crushed by the load. ABATEMENT CERTIFICATION AND DOCUMENTATION IS REQUIRED. Among other methods of abatement, one feasible and acceptable method of abatement would be to use dunnage to prevent the loads from shifting and to instruct the drivers not to use the rollback bed to attempt to dump the load.
