North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:
The employer did not furnish each of his employees conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to electrical hazards while living in
temporary migrant labor camps:
Temporary Migrant Labor Campsites - Employer allowed migrant workers to
occupy migrant labor camps
while electrical hazards were present as follows:
a) Three workers living in the brown wood-framed house located at 5729
Anthony Creek Rd. were
exposed to electrical hazards as follows:
One make-shift ceiling light fixture consisted of a light bulb screwed
into a socket with hanging
wires connected directly to the wires in the ceiling.
Two temporary wires were spliced together with live wires exposed and
running along the floor
to provide electricity from the bathroom to one of the bedrooms.
b) Three workers living in the trailer at 5474 Anthony Creek Rd. were
exposed to electrical hazards as
follows:
One ceiling light fixture was hanging from exposed live wires. This
ceiling was sagging from an
active water leak.
One make-shift ceiling light fixture consisted of a drop cord with a
two-prong socket plugged
into its end and secured to the ceiling by way of the wires hanging
outside of the electrical box.
There was evidence of water damage on the ceiling around the box.
A drop cord was stripped of its plug on the receiving end, wired to the
water heater, and
plugged into an outlet on the other end. This condition was present in the
bathroom, a damp
location.
Among others, one feasible and acceptable means of abatement would be to
ensure that all electrical wiring
meets local building code and National Electric Code standards.
