North Carolina General Statute 95-129(01) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees  conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in
that employees were exposed to falls in excess of 25-feet (Reference:
Operators and Safety Manual):
a)new church construction - where 2 employees were installing metal
framing onto the structural
steel frame from a JLG 40 RTS Self-Propelled Elevating Work Platform
(Scissor-Lift) with
hand and battery operated tools.  One employee exited the work platform
and was outside the
safety railing of the scissor-lift on a steel beam at approximately
27-feet above packed earth
without any type of fall protection system in use.
ABATEMENT NOTE:  Among others, one reasonable and feasible method to
reduce this hazard would be to
instruct employees on prohibited practices as set forth in the Operator's
Manual and provide individual training
on specific equipment which the employee may be expected to encounter.
