North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard. a)facility, assembly area - where employees used underhung cranes (hoists) such as CM 1 Ton Hoist (serial number 081EX), a Coffing 2 Ton Hoist (serial number TK406) and a Yale 2 Ton Hoist (serial number K144686) to lift and move trench roller components weighing up to 1000 pounds; the underhung cranes had defects such as hooks with missing safety retainers and unmarked load capacities. Abatement Note: One feasible and acceptable abatement method is to follow industry requirements for inspection and repair of underhung cranes. (Reference: American Society of Mechanical Engineers, for Overhead Hoists (Underhung), ASME B30.16-1993, 16-2.1.2 Frequent Inspections).
