North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to falls to a lower level by misusing the top step
of a step ladder:
a)site-maintenance employee of the company demonstrated the method of
accessing a roof
opening and admitted to standing on a Werner aluminum self supporting 8'
step ladder by
stepping on and standing on the top rung and the top plate of the step
ladder, exposing himself
to a fall of approximately 15 feet (ref warning label affixed to the top
step of the ladder).
ONE FEASIBLE MEANS OF ABATEMENT IS TO INSTALL AND USE THE PROPER
TYPE OF LADDER THAT WOULD ALLOW THE EMPLOYEE TO SAFELY ACCESS
THE ROOF.
