North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to:
a)facility - where employees were allowed to use including, but not
limited to, a Barrington hook-type underhung 2 ton hoist that was used to
lift hard tops (approximately 400-500 lbs) that was
missing its hook latch.  The hoist was not inspected in the past 12
months.
One feasible and acceptable abatement method, among others, to correct
this hazard is to
replace the missing latch and conduct inspections of the hoist.
b)facility - where employees were allowed to use including, but not
limited to, a Barrington hook-type underhung 2 ton hoist that was used to
lift hard tops (approximately 400-500 lbs) where the
structure supporting the hoist and weight of the lift was not load rated
to
determine its load
capacity.
One feasible and acceptable abatement method, among others, to correct
this hazard is to
determine load rating of the support beams and label the beam with the
load rating.
