North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:
The employer did not furnish each of his employees conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to: crushing/amputation
[Ref: American National Standard (ANSI Z245.5-1997) para. 7.1 (c)]
a)facility, baling room - employees of Sparrow Enterprises, Inc (dba)
Labor Finders were
operating a Galaxy 2R Two-Ram Baler serial number 165213, model
2R-150-57-N-F and the
employer did not ensure that temporary employees who ran a Galaxy 2R
Two-Ram baler
followed appropriate procedures to safely operate the equipment including,
but not limited to,
steps to prevent and clear material jams.  A temporary employee suffered
the amputation of
both legs while attempting to un-jam the baler.

b) facility, baling room - The employer did not maintain records of this
training to include the
date (s) of the training and the content of training conducted.
c)facility, baling room - The employer did not ensure by adequate
supervision, that correct
operating and maintenance procedures were understood and followed.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to
provide instruction to all employees in the applicable procedures
contained in the
manufacturer's manual for operation and maintenance of the equipment and
to provide
supervision to ensure that such procedures are followed.  For non-English
speakers, such
training should be in the employee's native language.
