Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees while changing batteries out of powered industrial trucks. Battery Changing Area: Employees who use the electric hoist to change batteries in powered industrial trucks were exposed to serious crushing injuries due to failure to properly seat the battery on the lifting hook. A feasible abatement method is to replace existing hooks with hooks equipped with safety latches.
