North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to being struck by:
a)jobsite, for the employee operating the Skid-Steer,
Bobcat 873, with an employee riding the Skid-Steer bucket
to patch a job.
Among other methods, one feasible and acceptable
abatement method to correct this hazard is to follow the
manufacturer's instructions for the Bobcat Operation and
Maintenance Manual for Model #873, and not allow any
rider.
