Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: crushing hazards associated with failing to use seatbelt restraints while operating a powered industrial trucks (Lull, Model T-8044 Pettibone Transverse). (a) Location - 130 Sylvan Street, Danvers, MA: On or about 07-08-2006, employees were exposed to crushing hazards while operating a powered industrial truck (Lull, Model T-8044 Pettibone Transverse) without using a operator restraint devices such as a seat belt. Among other feasible means of abatement would be to follow the manufacturer's operator's manual which states; 1. Before Operating the Machine. Check the following condition and operation of the seat belt and the mounts. 2. And; ASME B56-61992 Paragraph 6.2.1: Before starting the rough terrain forklift truck: (a) be in operating position and fasten seat belt, if so equipped.
