North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a)shop, periodic inspections and load test with certificate were not conducted and maintained for the Coffing 1-ton hoist. One feasible and acceptable method to correct this hazard is to conduct periodic inspections, at least annually, according to manufacturer's recommendations and ASME/ANSI Standards B30.16-2003 for overhead hoists (Underhung) and for the load test - test load with no more than 125percent of the rated load unless otherwise recommended by the manufacturer.ns a)shop, periodic inspections and load test with certificate were not conducted and maintained for the Coffing 1-ton hoist.
