Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from a work platform on a traveling rough terrain forklift: a) Jobsite - Employees were traveling approximately 50 feet from one work location to another while in the work platform on a JLG Skytrak. The work platform was not secured and slipped off the forks while the employees were at a height of approximately six feet above ground. Among other methods, one feasible method to reduce this hazard is to follow the AEM Safety Manual for operating and maintenance personnel which states, "Warning: Never drive the vehicle with the work platform in a raised position or with personnel on board, even for a short distance", or follow the manufacturer's owners/operators manual which states under Safety Practices, 6. "Never transport personnel in a work platform for even the shortest distance", and under Operation, Elevating Personnel, "Warning: Never drive the vehicle with the work platform in a raised position or with personnel on board, even for a short distance".
