Title 40.1-51.1(a), Code of Virginia: Employer did not furnish employment, and a place of employment which were free of recognized hazards that were causing, or likely to cause death or serious physical harm to employees in that: Employee(s) was exposed to fall hazards while performing job related duties when employee(s) were permitted to work from a job made box lifted by the forks of a Pettibone T8044 forklift. The Pettibone T8044 forklift should not be used to elevate personnel, as it is not designed for this purpose. One feasible, and acceptable abatement method among others to correct this hazard is to comply with the signs posted in the operators compartment, and in the safety booklet which read: Warning No Riding, and Improper carrying of personnel can result in death or serious injury. This forklift should not be used to elevate personnel unless there is no other practical option available. If this forklift must be used to elevate personnel, use only approved work platform. A rough terrain forklift is designed to lift and transport materials and should not be used to elevate personnel. Only equipment designed specifically to elevate personnel should be used for this purpose.
